Following is an update on the recent developments of the Nation of Hawaii and our Web Pages. If you are new to this list, e komo mai, welcome! HEAD OF STATE KIDNAPPED/ARRESTED BY POLICE! Pu`uhonua Kanahele, the Head of State of Hawaii, was kidnapped ("arrested") by local police and spend last Tuesday night in jail, for outstanding warrants that were several years old related to travelling with "SOVEREIGN" license plates. (He said he got a good night's sleep and did a lot of educating on the inside...) The Nation's Attorney General, Maltbie Napoleon, challenged the court's jurisdiction at the arraignment hearing Wednesday, citing a conflict of law (between the Nation's Hawaii Constitution and the federal and state constitutions, which are invalid in Hawaii). His motion was accepted by the judge, to be taken up in court on September 15. These events have stimulated discussion and support, and have raised the awareness of Hawaii's true legal status to a new level. Several unique circumstances have developed, including one judge giving community service that can be fulfilled with the Nation of Hawaii, and another judge removing himself from a case dealing with a citizen of the Nation after being served with a legal notice from the Nation's Attorney General's Office. THOMAS LAW REVIEW Professor Francis Anthony Boyle, of the University of Illinois College of Law, presented his interpretation of the United States' Apology to Hawaii (US Public Law 103-150), "Restoration of the Independent Nation State of Hawaii Under International Law," at the St. Thomas University's symposium this spring on tribal sovereignty. His address, updated from his original testimony to the Hawaiian Sovereignty Advisory Commission in 1993, appears in the St. Thomas Law Review, Volume 7, Summer 1995, which is available by calling Mr. Tony Kovalchik at St. Thomas University - (305) 623-2380.
