Last spring, a juvenile-court judge found that youths held at the juvenile-detention center in Jena, La., had been treated no better than animals. The facility was shot down, and it has earned a place in Amnesty Internationalbs new report, "Hidden Scandal, Secret Shame: Torture and ill-treatment of Children." The chief executive of Wackenhut Corp., which operated the Jena prison for the state, told The Palm Beach Post: "We grossly underestimated the amount of scrutiny we would come under." But Wackenhut is hardly unique among private-prison companies in its efforts to avoid the public eye. In an annual report, the industry-leading Corrections Corporation of America warns investors that "public scrutiny" is a risk "inherent" in the prison business. Today these and other private companies are vying for a new wave of contracts with the Federal Bureau of Prisons for some 10,000 beds, from California to Florida. Non-U.S. citizen prisoners would be transferred to these new prisons as they neared completion of their federal criminal sentences. The idea is to open up space in the federal facilities, and to position the prisoners so that the Immigration and Naturalization Service can take custody of them easily and begin deportation proceedings more efficiently. The proposed Wackenhut facility in Kendall is part of this latest prison-building boon. Kendall residents have been protesting the plan, but there are reasons other than Not-In-My-Back-Yard to object. The private prison industry is clearly falling behind the public system in maintaining the basic human rights of those it confines. This may be an inevitable outcome when prisoners become commodities. Whatbs more, private incarceration-for-profit raises fundamental questions about the principles of democracy. The nationbs public prisons and detention facilities are far from problem-free. But the private prison industry is fraught with a higher level of serious deficiencies than the public system. These problems include poor medical care (former nurses in a CCA/INS facility in Houston report that adults have been given pediatric doses of hepatitis medication because itbs cheaper); insufficient education and treatment programs (both of which were cited by the judge who closed down Jena); and higher rates of staff turnover, resulting in inadequate levels of experienced, well-trained personnel. Violence is another problem that may be exacerbated by privatization. A recent survey compared major incidents in private prisons with national data from similar public facilities. There were 49 percent more assaults on staff and 65 percent more inmate-on-inmate assaults in private facilities. In Texas, state officials levied $625,000 in fines against Wackenhut for chronic staff shortages; shortly after, alleged criminal activity at the Travis County State Jail led to a dozen indictments of Wackenhut guards for sexual abuse of prisoners, and the state took over the facility. INS detainees around the country have charged that the immigration agency uses its contracted employees for the "dirty work" of beatings and arbitrary use of isolation. The INS is already notorious for its lack of accountability. In the 1950s, the INS commissioner decentralized the agency and isolated the regional offices specifically to avoid the intrusion of Congress. Today local advocates try to remedy local abuses b such as the recent allegations of sexual abuse against women at Krome b but there is simply no meaningful, independent oversight. It has become an open secret that Washington INS officials cannot control their local subordinates. The extra layer of insulation from public scrutiny that private companies provide makes things only worse. Policymakers refer to the prisoners who will sleep in the 10,000 new beds as "criminal aliens." Legalistically, that is accurate. But such words, wielded to deflect public sympathy, are more dangerous than the prisoners themselves when they help to justify the mistreatment of human beings whom the state (and its private contractors) have confined. He is a bright child who is Failing his coursework. Therefore, he needs as much tutoring as is necessary to help him catch up in and pass his classes -- and to restore his interest in academics. I am sorry that we ran into a roadblock with the child-study-team, but I feel that it would be very wrong to punish a child (force him to do something degrading like peeing in a cup to be drug-tested) for doing something that is GOOD---- eg: for COMPLAINING to his parents & teachers about student drug use peer pressure at his school. It must have take a great deal of courage for him to stand up and say something about it to the teacher in front of the whole class. I am CERTAIN that he was speaking on behalf of some of his peers ( friends) who want the adults to remove this peer pressure --- and Brian was willing to be their spokesman. This Penal-Institution type policy of drug-testing is obviously not working and is psychologically degrading & insulting to the children ----implying that they are not to be trusted and are to be treated as potential criminals. A WAY more effective approach would be the EDUCATIONAL PROGRAMS (outlining the DANGERS of drug & alcohol use) which I urged the staff to present in our meeting with Jennifer. For now, I believe that Brian just needs to have his psychological "aversion therapy to academics", which happened during the past 2 years, reversed by WHATEVER ACADEMIC ASSISTENCE HE NEEDS TO SUCCEED IN HIS COURSEWORK. We will just have to by-pass the child-study-team for now and get him that help. I think that when he starts to get good grades & receive some more positive feedback that his battered self-esteem will be restored and his motivation & academic performance will return to normal. We still need to thank & pay his former tutor for her work with him. (Sorry that I did not get a chance to meet her). Brian says that he enjoys his friends at Shore and is otherwise happy at this school. Because neither Brian's father nor I ever attended Public School, we are not familiar with the policies (much more rigid than in Private Schools). I need to be informed of what the policies are -----and then we can either use them to the benefit of the child OR ( if they are "bad" policies that the staff, students & parents are temporarily stuck with) we will just have to get around them somehow, so that we are not prevented from PROVIDING FOR THE CHILD'S EDUCATIONAL NEEDS.
